HOMAGE Ambassador Program - Terms and Conditions

HOMAGE hosts an Ambassador Program (the “Program”), through which qualifying participants (each, an “Ambassador”) may earn commissions by referring new customers to www.homage.com. The Program is administered on HOMAGE’s behalf through the affiliate marketing platform operated by Impact Radius (“Impact” or the “Platform Provider”). By applying to or participating in the Program, you (an “Ambassador”) agree to be bound by HOMAGE’s Terms of Use and Privacy Policy (each available on homage.com), Impact’s Terms of Service (available on Impact’s website), and the following additional terms and conditions governing the Program (these “Terms”). HOMAGE reserves the right to update these Terms at any time as described in Section 8 below.
1. Eligibility
Participation in the Program is limited to individuals located within the United States who are at least eighteen (18) years of age. The Program may not be used by corporate entities, businesses, or teams, as determined in HOMAGE’s sole discretion. Ambassadors are not required to be current or former HOMAGE customers to apply or participate.
2. Key Definitions

“Qualified Referral.” A purchase completed at homage.com by a consumer who (i) clicks an Ambassador’s unique referral link within the immediately preceding sixty (60) days, and (ii) submits their first name, last name, and email address in connection with that click-through.

“Referred Consumer.” The individual who completes a Qualified Referral. A Referred Consumer may not be the same person as the referring Ambassador, including through the use of an alternate email address. A Referred Consumer must submit their first name, last name, and email address in order to receive their promo code.
3. Referred Consumer Discount
Upon submitting the required information described in Section 2, a Referred Consumer will receive a one-time promo code entitling them to 20% off their next purchase at homage.com, subject to the following conditions:

4. Ambassador Referral Rewards
For an Ambassador to earn a referral reward (a “Reward”), the following conditions must be satisfied:

Completed Purchase. The Referred Consumer must submit their first name, last name, and email address, and must complete a purchase of $50 or more within 60 days of the initial click.

No Return or Cancellation. The qualifying order must not be returned or cancelled within sixty (60) days of purchase. Orders that are returned or cancelled within this window will result in cancellation of the associated Reward.

Combinability. Rewards cannot be combined with other Ambassador offers; however, an Ambassador will still be credited for an order even if the Referred Consumer applies another promotional offer at checkout, provided the Referred Consumer clicked the Ambassador’s referral link, submitted their information, and completed the purchase within sixty (60) days of that initial click.

Non-Transferability. Rewards may not be sold, transferred, or applied to past purchases.

No Expiration. Earned Rewards do not expire.
5. Reward Payment & Tax Reporting

Pending Period. Ambassadors will be notified when a Referred Consumer they referred completes a qualifying purchase. The associated Reward will remain in pending status for sixty (60) days, consistent with HOMAGE’s standard return policy.

Release & Remittance. Following the 60-day pending period, the Reward will be released to the Ambassador’s account and may be remitted via ACH bank transfer or PayPal (PayPal remittances are subject to a three percent (3%) processing fee).

Dashboard. Reward status, referral performance, and payout history are viewable on the Ambassador’s private Program dashboard. Bank, PayPal, and tax information must be maintained by the Ambassador through this dashboard.

Tax Responsibility. Ambassadors are solely responsible for any tax liability arising from Rewards received and will be required to submit a completed Form W-9 once they reach the applicable payment reporting threshold.
6. Prohibited Conduct; No Spam
Ambassadors must comply with all applicable anti-spam laws and regulations. Distribution of referral links via unsolicited bulk email (“spam”) is strictly prohibited and constitutes grounds for immediate termination from the Program. Each Ambassador agrees to indemnify and hold HOMAGE harmless from and against any claims arising from the unlawful distribution or sharing of their referral link.
6A. FTC Compliance — Social Disclosure Requirement
Disclosure of Material Connection. Where an Ambassador shares a referral link, discount code, or other Program content via social media or any other public-facing content (including posts, stories, videos, livestreams, or comments), the Ambassador must clearly and conspicuously disclose their material connection to HOMAGE in accordance with the FTC’s Endorsement Guides (16 C.F.R. Part 255) and any applicable platform-specific disclosure policies. Acceptable disclosures include the hashtags #Partner or #Ad, which must be displayed prominently and not buried within a block of unrelated hashtags, captions, or a "read more" section. HOMAGE additionally encourages, but does not require, Ambassadors to include #TeamHOMAGE on qualifying content.
Ambassador Responsibility. Each Ambassador is solely responsible for ensuring their content complies with the FTC’s Endorsement Guides and any other advertising disclosure laws applicable in their jurisdiction. Failure to include a compliant disclosure constitutes a violation of these Terms and may result in suspension or termination from the Program and forfeiture of any pending or future Rewards associated with the non-compliant content, in addition to any other remedies available to HOMAGE under these Terms.
7. Right to Suspend Accounts; Cancel Program or Modify Terms
HOMAGE reserves the right, in its sole discretion, to suspend or close the account of any Ambassador or Referred Consumer suspected of misusing the Program or violating these Terms. HOMAGE further reserves the right to modify these Terms or to cancel the Program at any time, for any reason, without prior notice. In the event of Program cancellation, any unclaimed or pending Rewards will be forfeited.
8. Privacy
Personal information submitted by Ambassadors and Referred Consumers in connection with the Program will be collected, processed, and used in accordance with HOMAGE’s Privacy Policy and Impact’s Privacy Policy, each available on the respective party’s website. Such information may also be used by HOMAGE or Impact to contact Ambassadors or Referred Consumers regarding their participation in the Program.
9. Platform Provider; Additional Restrictions

The following promotional tactics are restricted. Engaging in any of the following may result in forfeiture of Rewards/payments and/or expulsion from the Program:

Trademark / Keyword Bidding. Ambassadors may not bid on HOMAGE’s trademarked terms (including but not limited to “HOMAGE,” “homage.com,” “www.homage.com,” “HOMAGE coupons,” or any variations or common misspellings thereof) in connection with search or content-based advertising campaigns on Google, Microsoft (MSN), Yahoo, Facebook, or any other network.

Coupon & Deal Sites; Browser Extensions. Referral links may not be placed or leveraged on deal/coupon aggregator sites, browser extensions, or other promotion-focused placements.

Cookie Stuffing & Related Tactics. Cookie stuffing, invisible pixels, link auctioning, and other tactics designed to artificially monetize deal- or coupon-based promotions are strictly forbidden.
9A. Invalid Activity — Fraud, Audit & Clawback
“Invalid Activity” means any click, referral, Qualified Referral, or associated purchase that HOMAGE determines, in its sole discretion, to have been generated through fraudulent, automated, deceptive, incentivized-but-undisclosed, or otherwise non-genuine means. Invalid Activity includes, without limitation:

traffic generated by bots, scripts, automated clicking or browsing tools, or other non-human means;
-
anomalous click or referral patterns, including abnormally high volumes of clicks or referrals from a single source, IP address, device, or account; click timing, frequency, or sequencing inconsistent with genuine human behavior; or repeated clicks unaccompanied by corresponding organic engagement;
-
clicks, referrals, or traffic sourced from purchased, incentivized, brokered, or otherwise undisclosed traffic arrangements not authorized in writing by HOMAGE;
-
manipulation of referral links, tracking parameters, or cookies through any means, including but not limited to cookie stuffing, forced clicks, invisible pixels, or link auctioning; and
-
any other activity that HOMAGE reasonably determines is intended to artificially generate, inflate, or misattribute referral activity or Rewards.
This definition is illustrative and not exhaustive; HOMAGE reserves the right to identify additional forms of Invalid Activity as new tactics emerge.
Audit Rights. HOMAGE (directly or through Impact) may monitor, review, and audit an Ambassador’s referral links, traffic sources, click patterns, and associated Rewards at any time, with or without notice, to detect Invalid Activity.
Clawback Rights. Where HOMAGE determines, in its sole discretion, that a Reward — whether pending, released, or already paid — is associated with Invalid Activity, HOMAGE may withhold, suspend, reverse, or claw back that Reward, and may require the Ambassador to repay any amount already disbursed. HOMAGE may exercise these rights in addition to, and without limiting, its rights under Section 7 (Right to Suspend Accounts; Cancel Program or Modify Terms), including suspension or termination of the Ambassador’s account and forfeiture of any other pending Rewards.
10. Relationship to General Terms
These Terms supplement, and do not replace, HOMAGE’s general Terms of Service and Privacy Policy, both of which continue to apply to your use of homage.com and participation in the Program.
11. General Boilerplate
Governing Law & Venue. These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to the Program or these Terms shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and each Ambassador consents to the personal jurisdiction and venue of such courts.
Entire Agreement. These Terms, together with HOMAGE’s Terms of Use, Privacy Policy, and Impact’s Terms of Service, constitute the entire agreement between the Ambassador and HOMAGE with respect to the Program and supersede any prior or contemporaneous understandings regarding its subject matter.
Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
No Waiver. HOMAGE’s failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or of HOMAGE’s right to enforce it at a later time.
Assignment. An Ambassador may not assign or transfer their Program account, rights, or obligations under these Terms without HOMAGE’s prior written consent. HOMAGE may assign these Terms,
